    Dear all

    Can we change industry code of company without alteration of MOA.

    • In case of alteration in object clause, if  there is any change in the industrial activity of the company then we can only we can change NIC Code.

    • The industry code or National Industrial Classification (NIC) code of a company is usually mentioned in the incorporation documents and the Registrar of Companies (ROC) records. If a company wants to change its NIC code, it can be done by updating the ROC records through the e-filing portal of the Ministry of Corporate Affairs (MCA).

      However, changing the NIC code of a company may require an alteration in the Memorandum of Association (MOA) of the company. The MOA of a company contains details about the company's objects and activities, and any change in the company's objects or activities would require an alteration in the MOA.

      If the change in the NIC code does not affect the company's objects or activities as mentioned in the MOA, then it may be possible to change the NIC code without any alteration in the MOA. In such a case, the company may have to provide appropriate reasons and supporting documents for the change in the NIC code while updating the ROC records.
