    Clarification regarding the term "Deposit".

    In terms of Section 73 of Companies Act, 2013 read with Rule 2(1)(c)(vii) of Companies (Terms and conditions of acceptance of Deposit) Rules, 2014, deposits do not include receipt of money from Director of the Company, but the money received from a member is treated as deposit. In case the deposit is taken from a person who is both a director and a member of the Company, will such receipt of money be treated as deposit or not

    • As per the provisions of Section 73 of the Companies Act, 2013 and Rule 2(1)(c)(vii) of the Companies (Acceptance of Deposits) Rules, 2014, the term "deposit" does not include any amount received from a director of the company. However, if the amount is received from a member of the company, it will be treated as a deposit.

      In case a person is both a director and a member of the company, any amount received from such person would be treated as a deposit or not will depend on the capacity in which the amount is being given. If the amount is being given in the capacity of a director, it would not be treated as a deposit. However, if the amount is being given in the capacity of a member, it would be treated as a deposit.
