As per the proviso of Section 167(1)(a) of the Companies Act, 2013, a director is liable to vacate the office in all other companies excepting the defaulting company. It means the person will have to continue as director in the defaulting company.
What is the term of director for which he is required to continue the office in this capacity as no specified tenure has provided by the Companies Act, 2013 ?
In private ltd company when two Non Resident company share holders, having two directors - not share holders.
Both the Directors wants to resign. Presently the Company has no operations and there are no employees.

Dear Members, Please reply on following query: One of client is convicted by court for an offence under Companies Act, 2013 and he is sentenced to imprisonment for 3 years. As per Sec 167 of Companies Act, 2013, he shall have to vacate office of director in all companies in which he used to be director. Now, my query is he have to vacate office of designated partner in LLPs also in which he is designated partner or no there is no any such provision in LLP Act and LLP Rules and if yes he have to vacate office of designated partner also, then where it is mentioned in LLP Act or LLP Rules. Please reply as soon as possible.
