If the subscriber to the memorandum is a foreign national and his/her signature and address needs to be notarized as per Rule 13 of the Companies (Incorporation) Rules, 2014, the signature of the subscriber can be attested by a notary public or a consul or a representative of the Indian Embassy or High Commission or a person authorized by the Indian Consulate.
The attestation process usually involves the following steps:
The subscriber signs the memorandum in the presence of a notary public, consul, representative of the Indian Embassy or High Commission, or authorized person.
The notary public or authorized person then verifies the signature of the subscriber and attests to the signature by signing and affixing their official seal.
The notary public or authorized person may also verify the identity of the subscriber and attest to their address by including it in the attestation.
The attested memorandum can then be submitted to the Registrar of Companies for incorporation.
It's important to note that the specific requirements for attestation may vary depending on the country of origin of the subscriber and the local laws and regulations.
Once the signature and address have been notarized or attested, the subscriber can send the original signed and notarized memorandum to the company's registered office in India. It is important to note that the memorandum must be sent by registered post or courier to ensure that it is delivered safely and securely.
