The appointment of 1st auditor of the company as the statutory auditor in the 1st AGM of the company should be for 4 years considering that he has audited the balance sheet of the current year, thereby completing a term of 5 years (1+4). Or does he have to be appointed for 5 years starting from the conclusion of the 1st AGM.
An Individual Auditor is appointed on 01/08/2018 due to casual vacancy arise due to resignation for F Y 2017-18, Auditor gives consent letter till the conclusion of AGM. But he is appointed for 5 years in AGM held on 05/09/2018.In Dec 18 Individual firm is converted into Pship Firm.
1 Can New Consent letter is required for 5 years from Individual Firm appointed in 05/09/2018.
2 Can we appoint Pship Firm as new auditor and ADT 1 is filed.
Is tenure for appointment of auditors mandatory to be for 5 years or lesser period is possible. Incase of a private company

Abc Pvt ltd is incorporated on 25/12/2017 and statutory auditor are appointed in 1st AGM held on 25/09/2018 for 5 years. But Statutory Auditor deny to Audit of 2018-19.
Can we appoint new auditor ?

I have a general question, not specific to any particular case, just a topic for discussion and knowledge enhancement. Can a Auditor be appointed for less than 5 years, for example 2 or 3 years for a private limited company? Never came across such a situation. As per Section 139 and also the rules it says 5 years maximum. This question was posed by another professional friend of mine. Views of esteemed members of this group are solicited.

Dear Members
My company was struck off and I was unable to file any e-Form for the period 2017-18 and 2018-19.
I want to have my auditor resigned on the date in period 2017-18 and the auditor has also agreed to resign. He even submitted a resignation letter and acknowledgement was received from the Company in the date in period 2017-18. But the auditor is not ready to sign on ADT-3 saying that if he signs the ADT-3 now for the period 2017-18, penalty will be imposed on him. But the problem is we couldn't have filed the form since the company was struck off.
Please suggest a solution to this problem.
There was some clerical error in balance sheet attached to original tax audit report due to which It has been revised. But the assesee is not accepting the said revised tax audit report. Plz suggest what can be done to avoid future litigation and problems since the tax department will process original tax audit report which has mistake.

IS IT NECESSARY TO INCLUDE ANY KEY AUDIT MATTER IN THE AUDITOR REPORT WHICH IS NEW FORMAT FOR 2019.
IN CASE OF SMALL PRIVATE COMPANIES (SAY 1 LAKH CAPITAL AND 3 LAKHS TURNOVER ), AUDITORS HAVE NOTHING TO SAY MUCH ABOUT AUDIT
