As per Section 196 (2) No company shall appoint or re-appoint any person as its managing director, whole-time director or manager for a term exceeding five years at a time.
Is the above provisions applicable to a Nidhi Company i.e. can a Nidhi company appoint a WTD for a period of 10 years.?

Kindly inform in case if holding company is having Whole time Company Secretary then in it's wholly owned subsidiary is there any exemption for appointment of Whole time Company Secretary as paid up capital of WOS is 11 crores and it is an unlisted public company.
