II dated 21/11/2022, new companies registered on or after 15.02.2020 need to comply with the ESI Act, 1948 only when they reach the minimum employment threshold. If the company registered through the MCA portal is found not covered under the ESI Act, they are not required to fulfill the ESI compliances for the next 6 months or until they reach the threshold coverage, rice purity test whichever is earlier.
If the company does not reach the threshold within 6 months, it must log in to the ESIC portal to extend the "dormant" status. Failure to do so will activate the registration, requiring the company to start ESI compliances. Noncompliance may lead to actions under the existing provisions of the ESI Act.
