Circular No. P-11/14/19/Misc/02/2022-Rev. II Dated 21/11/2022, the ESIC has provided that the new companies registered on or after 15.02.2020, shall comply with the provisions of the ESI Act, 1948 only when they reach the threshold limit of employment under the ESI Act. In case, the companies registered through the MCA portal are found not coverable as per the statutory provisions of the ESI Act, they are not required to do compliances for the next 6 months or till they reach the threshold ESIC coverage, whichever is earlier.
Dormant Status: If the company does not reach the threshold in 6 months, it has to login on to the ESIC portal to further extend the “dormant” status. In case, it does not extend the same, the registration will get activated and the company has to start doing compliances under the ESI Act. In case, compliances are not done, actions under the existing provisions of the ESI Act may be taken against the defaulting units.

I’ve started a private limited company in 2021. Currently there are no employees. However EPFO and ESIC registration was done as there was some process that automatically opens EPFO and ESIC accounts as well during incorporation.
Now that the accounts are open, am wondering if there is any filings requirement.
If yes, how do I file EPFO and ESIC returns for a company having no employees.

Name approval was done before 15.02.2020 hence it was incorporated using earlier SPICE form and AGILE form instead of SPICE + and AGILE pro but actually incorporation process completed in 3rd March, 2020 (after the cut off date as per shram suvidha portal). ESI and PF registration was optional in Eariler AGILE form which is mandatory in AGILE pro form and we opted for not to register under ESI and PF Act at the time of incorporation. Now there business is expanding and they mandatorily have to register under ESIC and EPF, but we could not process that because "https://registration.shramsuvidha.gov.in/" portal is not supported for the same.
Technical Problem:
Message displayed is " You are not authorised for registration. Registration for EPFO and ESIC for new public & private limited companies and OPC has been stopped on Shram Suvidha Portal from 15.02.2020.
W.e.f. 15.02.2020, new public and private limited companies and OPC shall get registration number for EPFO and ESIC on MCA portal through SPICE + and AGILE pro e forms only at the time of incorporation.
However, the above new companies will have to comply with the provisons of EPF & MP Act, 1952 and ESI Act, 1948 when they cross the threshold limit of employment under the respective acts.

Incorporation Forms sent for Resubmission with following remarks:
1. Details in column 14 of AGILE-PRO w.r.t. ESIC registration have not been selected. Further you are required to provide the correct Branch office and Inspection office from the available drop-down options.
However, for city which are not cover under the list of Implemented area, column 14 of AGILE-PRO automatically hide and not allowed to select information i.e. Branch Office and Inspection Office.
Anyone have any idea how to resolve this query.
Ticket raised but in reply i received messary that contact CRC. No one receiving call on CRC Helpdesk.
