    Surrender of DIN: DIR-5

    Dear Members,

    A past Director of a Company having settled abroad wants to surrender his DIN.

    1. Can he surrender his DIN by filing DIR-5?

    2. If he is not qualified to file DIR-5 as he was a Director in a Company, any alternative option to surrender DIN is available?

    3. If he has no option whatsoever to surrender DIN, is there any harm in holding the DIN? Or, is it rather prudent to hold it, so that he need not apply for DIN again if he wants to be on the Board of an Indian Company in future?

      DIR-5 can be filed with any reason such as

      DIN is unused and not intended for future reference also

      or multiple DINs are allotted to same person

      or DIN holder is no more/has become of unsound mind or insolvent etc. 

      Therefore while surrendar declaration tneed to give that you never been appointed as director in any company and the said DIN has never been used for filing of any document with any authority, the Central Government may deactivate such DIN: 

      Provided that before deactivation of any DIN in such case, the Central Government shall verify e-records.
